European Court overrules Azerbaijan’s appeal

Elchin Sadigov, attorney of imprisoned journalist Eynulla Fatullayev, has informed AzadliqRadiosu that the European Court of Human Rights has upheld its verdict on the case of the editor-in-chief of “Gundelik Azerbaijan” and “Realniy Azerbaijan” newspapers.

According to Sadigov, the European Court gave its final verdict on the case today. That is to say, the European Court has upheld its verdict from April 22 of this year. That verdict demanded Eynulla Fatullayev’s immediate release, and 28 thousand Euros to be paid to him. Azerbaijan, having not agreed with this verdict, appealed to the Upper House of the Court.

In 2007, Eynulla Fatullayev was sentenced to 8-and-a-half years in prison, on charges of terrorism, defamation, incitement to racial hatred and tax evasion. In December 2009, his prison cell was searched and prison officers said they found 0.22 grams of heroin in his shoes. The journalist denied this charge, saying that the drugs were deliberately placed in his clothes.

However Qaradagh Disrtict Court, on 6 July of this year, gave a verdict of 2-and-a-half years of imprisonment for the journalist. An appeals procedure regarding this case has taken place several times at Baku Appeals Court. After familiarizing himself with the protocols, he made notes and returned the protocols to Qaradagh District Court, in order to receive an explanation.
